# nxml-pokemon-legends-za — Non-Commercial Research License v1.0

> the licensor — primarily the 26-dim controller-action recordings, the
> per-episode metadata, the parquet/manifest schemas, and the encoding /
> packaging code. It does **not** purport to license any underlying
> audio-visual game content.

> The video frames included in this dataset depict **Pokémon Legends: Z-A**.
> All rights in the underlying game audio-visual content (including but not
> limited to character designs, models, environments, music, sound effects,
> user-interface elements, and on-screen text) are reserved by their
> respective owners: **Nintendo Co., Ltd.**, **The Pokémon Company**,
> **Game Freak Inc.**, and **Creatures Inc.** This dataset is not licensed
> by, endorsed by, or affiliated with those rights holders.

## 1. Definitions

- **"Dataset"** means the files distributed under this license at the
  HuggingFace dataset repositories `arelius/nxml-pokemon-legends-za`,
  `arelius/nxml-pokemon-legends-za-mp4`, and
  `arelius/nxml-pokemon-legends-za-latents`, including video files,
  parquet files, manifests, README, and accompanying code.
- **"Licensor"** means Clark Saben, the uploader.
- **"You"** means the individual or entity that has accepted the gated-
  access terms on HuggingFace and is exercising rights under this license.
- **"Non-commercial research"** means academic or personal research that is
  not, and is not intended to be, sold, licensed, or otherwise
  monetised, and that is not undertaken by, for, or on behalf of, a
  commercial entity for the development of a commercial product or
  service.

## 2. Grant of rights (limited to the Licensor's own contribution)

Subject to your compliance with the terms below, Licensor grants you a
worldwide, royalty-free, non-exclusive, non-sublicensable, revocable
license to:

a. download a single copy of the Dataset to a machine under your control;
b. use the Dataset for **non-commercial research** purposes, including the
   training of statistical / machine-learning models for personal study
   or academic publication;
c. publish results (figures, tables, qualitative descriptions, model
   weights) derived from such research, provided that those results do
   not enable bulk reconstruction of the original audio-visual content.

This grant **does not** include any rights in the underlying audio-visual
game content. Those rights remain with the rights holders identified above.

## 3. Restrictions

You shall **not**:

a. use the Dataset, in whole or in part, for any commercial purpose;
b. redistribute, mirror, host, sell, sublicense, or otherwise make the
   Dataset (or any meaningful portion of the video frames it contains)
   available to third parties — instead, direct them to the original
   gated HuggingFace repositories;
c. publish model weights whose primary intended or marketed use is to
   regenerate, upscale, or reconstruct the underlying audio-visual game
   content depicted in the Dataset;
d. use the Dataset in any way that would mislead a reasonable observer
   into believing the Dataset, or works derived from it, are endorsed by,
   licensed by, or affiliated with the rights holders identified above;
e. remove or obscure this `LICENSE` file, the gated-access notice on the
   HuggingFace repository, or the attribution to the rights holders in
   the README.

## 4. Takedown

Licensor will, on receipt of a credible request from any of the rights
holders identified above (or their authorised representatives), remove the
Dataset from public distribution promptly. Your license terminates
automatically on such removal, except that this section and Section 5
(Disclaimer / liability) survive.

## 5. Disclaimer & liability

THE DATASET IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ABSENCE OF
THIRD-PARTY CLAIMS. IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY
CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT,
TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE
DATASET OR THE USE OR OTHER DEALINGS IN THE DATASET. You are solely
responsible for evaluating whether your use complies with the intellectual
property rights of the rights holders identified above and with applicable
law in your jurisdiction.

## 6. Termination

This license terminates automatically if you breach any of its terms, or
on the removal contemplated by Section 4. Upon termination you must cease
using the Dataset and destroy any local copies. Sections 4 and 5 survive
termination.

## 7. No legal advice

This license is provided in good faith but is not legal advice. If your
intended use is non-obvious — in particular, anything that touches on
commercial activity, public model release, or large-scale redistribution
of derived content — you should consult a qualified attorney.
